Again no hearing on Ayodhya case on 29 Jan, fixed for the bench to sit.

The hearing on the Ramjanmabhumi case in the Supreme Court, scheduled for 29th Jan stood canceled because Justice S A Bobde- will not be available on that day.

Office of the Supreme Court communicated the message to “all concerned” through a notice.

The one paragraphed notice read: “due to non availability of Justice S A Borde on dated 29.01.2019 Tuesday, sitting of the constitution bench in Honorable Chief Justice’s Court, comprising Honorable Chief Justice, Honorable Mr. Justice SA Bobde, Honorable Mr. Honorable Mr.Justice Y Chandrachud, Honorable Mr.JusticeAshok Bhusan,Honorable Mr. Justice S Abdul Nazeer, stands cancelled. Therefore, Constitution bench matter will not be taken for hearing.”

Chief Justice Ranjan Gogoi had to reconstitute the bench on January 25 as Justice U U Lalit withdrew himself from the panel on the 10th of this month after his place in the panel was questioned on the very first minute of its sitting. Justice Ashok Bhushan and Justice S Abdul Nazeer had been taken in the new panel in place of Justice UU Lalit and Justice NV Ramana.

There is no mention of any new date of hearing in the notice. On January 4, the Supreme Court took up the Ayodhya title suit and advanced it to January 10 for a constitution bench. The Constitution bench of five members comprising of Chief Justice Ranjan Gogoi, Justices SA Bobde, NV Ramana, UU Lalit, and DY Chandrachud was formed on the 8th. It sat on the 10th for hearing but extended the date to 29th following “UU Lalit recused himself from hearing the matter.” His withdrawal from the case is reported to be because Advocate Anil Dhawan said that the later had appeared for Kalyan Singh in the Ayodhya Matter.
